Eligible U.S. citizens’ public gun carrying would be protected from state and local penalties, except where private owners clearly ban guns or state-law firearms screening occurs.
States and local governments could not penalize eligible U.S. citizens for carrying guns in public. Exceptions would cover private places with clearly communicated gun bans and places with firearms screening under state law.
State and local rules penalizing or indirectly discouraging covered public gun carrying, including through financial barriers, would have no effect. Coverage would apply to resident and visiting U.S. citizens eligible to possess firearms under both state and federal law. It would extend to D.C., Puerto Rico, and U.S. possessions, excluding the Canal Zone. Private places open to the public would be excluded when owners clearly and conspicuously communicate a gun ban. Places where firearms screening occurs under state law would also be excluded.
