Starting July 1, 2026, the state treasurer would keep 14% of gross retail marijuana sales tax revenue in the general fund and transfer specified shares to three state funds. The distribution covers gross retail marijuana sales tax revenue handled under the cited marijuana tax law. The 14% retained in the general fund may be used for any lawful purpose. The treasurer would transfer 73.17% to the Marijuana Tax Cash Fund, 11.33% to the State Public School Fund, and 1.50% to the Marijuana Cash Fund. This distribution would apply on and after July 1, 2026.
Each June 30, the state treasurer would transfer money from the Marijuana Tax Cash Fund to the State Public School Fund after accounting for specified amounts. The rule covers the balance of the Marijuana Tax Cash Fund, including money appropriated from it and money designated for the state emergency reserve. The transfer amount would equal the fund balance minus 15% of the amount the General Assembly appropriated from the fund for that fiscal year. The calculation would also account for any amount designated by the General Assembly for the state emergency reserve. The first transfer would occur June 30, 2027, with another transfer every June 30 after that.
