If no referendum petition is filed, the law takes effect August 12, 2026, and requires Colorado’s Department of Corrections to review parole risk assessments and report results each year.
The Department must establish a team to check parole risk assessments and train assessors. Reviews must cover each risk level and periodically check assessors’ work.
At its annual legislative hearing, the Department must report on assessment reviews, errors that led to wrong supervision levels, and steps to improve the process.
Parole risk scores and resulting supervision levels count as criminal justice records. Agreements cannot block disclosure when the records law allows those outputs to be released.
The Department must establish a team to review parole risk assessments and support accurate, consistent scoring. Reviews cover community supervision assessments and similar successor tools used to guide parole supervision. The review system must include completed assessments at each risk level, periodic checks of assessors’ work, and training. The team must put its review policies and practices in place by August 31, 2026.
The Department must report assessment review results and improvement steps at its annual legislative hearing. The reports cover community supervision assessments and similar successor tools reviewed under this section. The report must include how many assessments were reviewed, how many contained errors that led to an inaccurate supervision level, and review findings and steps to address them. Reports begin in January 2027 and continue each January after that.
The law defines parole risk scores and resulting supervision levels as criminal justice records and voids agreements that block disclosure of covered outputs. Risk assessment outputs mean a parolee’s total score and resulting supervision level from a validated tool that assesses needs and risk. Only information subject to disclosure under the criminal justice records law is covered; this does not make every record public. The rule voiding agreements applies to record requests made on or after the act’s effective date.
