Colorado’s department sets rates for fresh frozen marijuana by July 2027 and publishes how it calculates each rate category while protecting sensitive information.
The department’s rates include fresh frozen indoor and outdoor marijuana. Initial rates for marijuana used in extracts must be lower than the rate for marijuana sold directly to consumers.
For each marijuana price category it sets, the department must explain the general methods and data used to calculate the rate while protecting sensitive information.
The department must include rates for fresh frozen indoor and outdoor marijuana and set initial rates for marijuana used in extracts below the rate for marijuana sold directly to consumers. The rates cover unprocessed retail marijuana sold or transferred from cultivation facilities to product makers or retail stores. Outdoor marijuana must be grown under natural sunlight and exposed to natural weather, with exceptions for limited artificial light, common farm practices, and protection under an approved severe-weather plan. The department must adopt rules setting the fresh frozen rates on or before July 1, 2027.
The department must publish a general description of the methods and data it uses to calculate each rate category. The descriptions cover each category of unprocessed retail marijuana for which the department sets an average market rate. The department must protect confidential, business-sensitive, and identifying information. The act took effect July 1, 2026.
