Starting in 2028, retailers must clearly display the lung cancer screening sign at every retail location.
Retailers could be charged $500 for each location where they fail to display the sign; three other specified penalties do not apply to this violation.
The State Department of Public Health must provide lung cancer screening awareness signs at no cost. The signs must include screening eligibility and effectiveness information, the Kick It California toll-free number, and a QR code linking to the program’s department website page. The sign may instead use a QR code linking to all required information. The department may create signs, use existing materials, or work with an existing campaign. The department must make the signs available by July 1, 2027. They must be no larger than 8.5 by 4 inches.
Retailers must clearly display the sign at each retail location. This requirement applies to each retail location covered by the bill’s definition of a retailer. The display requirement begins January 1, 2028.
The California Department of Tax and Fee Administration must issue a $500 civil penalty for a retailer’s failure to display the sign. The penalty is $500 for each offense at a retail location where a retailer fails to display the sign. The agency issues the penalty when it discovers a location without the required sign, using procedures for a related existing penalty. A retailer is not subject to three specified other penalties for this display violation. The penalty applies to failures to display the sign under the requirement that begins January 1, 2028.
