Nursing assistants can qualify for help with substance use monitoring costs if funded, while certain disciplinary actions must stay off public websites.
Workers’ disciplinary actions must stay off public websites when they substantially follow board orders or agreements tied to substance use monitoring. Outside websites are covered only when regulators can prevent posting.
If money is set aside, eligible workers with financial need may receive help paying substance use monitoring costs. Payments can cover up to 80 percent of each eligible expense.
State nursing regulators cannot post covered disciplinary actions, supporting documents, or notices of those actions on public websites. The rules cover nursing assistants and other workers with credentials under the two nursing credential chapters named in the law. A board order or agreement must require the worker to contact an approved substance use disorder monitoring program and participate if the program recommends it. The board must find that the worker has substantially followed the order or agreement. For an outside website, the department or board must be able to prevent posting. These provisions took effect July 1, 2026.
The nursing board must establish a program to help pay monitoring expenses if money is set aside for that purpose. Nursing assistants and other covered nursing workers may qualify with an active, inactive, or suspended credential. Applicants must show financial need and be participating in the approved monitoring program or have completed it within six months before applying. Workers must use the board’s application forms and document their expenses. Anyone who previously applied for and participated in the payment program is ineligible. The board may cover up to 80 percent of each eligible expense for evaluation, treatment, and related services. The board must update its website with participant counts, average and total payments, and available program funds. These provisions took effect July 1, 2026; the payment program depends on funding specifically for that purpose.
