Pharmacists may dispense ivermectin without a prescription under state pharmacy procedures, with the law’s protections beginning 91 days after the legislative session ends.
1
What it does
Pharmacists may dispense ivermectin without a prescription under written state procedures. Those procedures may require instructions, and reasonable conduct receives criminal, civil, and disciplinary protection.
Argument forPeople may be able to obtain ivermectin directly from a pharmacist, with state procedures potentially requiring instructions for proper use.
Argument againstThe liability protection could make it harder to hold a pharmacist responsible when ivermectin is dispensed, although it applies only to reasonably prudent conduct.
More detail
A pharmacist may dispense ivermectin without a prescription from a licensed health care practitioner. This applies to pharmacists dispensing ivermectin to a person. The pharmacist must follow written procedures or protocols issued by the Texas State Board of Pharmacy. Those procedures or protocols may require the pharmacist to give instructions for proper use. A pharmacist receives the stated protection only when acting in a reasonably prudent manner and dispensing under this section. The provision is scheduled to take effect on the 91st day after the last day of the legislative session.
